Mantarraya Dorada S. de R.L. de C.V. is a legal entity duly incorporated under Mexican law and is responsible for processing your personal data.

Welcome to our website www.daytourbacalar.com (the "Site"), owned by Mantarraya Dorada S. de R.L. de C.V. By purchasing our services, the user (the "Client") expressly accepts the following terms, conditions and policies:

1. Use of the Site and Booking

When making a reservation through the Site or any other official DayTour Bacalar channel, the Client expressly agrees to:

• Be of legal age and have legal capacity to enter into a contract.
• Provide truthful information when making the reservation.
• Accept and comply with our safety, operational and cancellation policies.
• Use our services properly and for the tourism purpose for which they were designed.

2. Reservation Policies

• DayTour Bacalar excursions are provided by advance reservation only.
• A reservation is considered confirmed only after receiving a confirmation email or confirmation ticket through WhatsApp or messaging from DayTour Bacalar's official social-media channels.
• If you have not received the email, check your spam folder or contact us at: info@daytourbacalar.com

3. Cancellation and Refund Policies

Tours Without Food Included

• Cancellation more than 24 hours in advance: 100% refund.
• Cancellation less than 24 hours in advance: No refund. You may reschedule your tour once at no charge with at least 4 hours' notice, subject to availability.
• No-show: No refund and no rescheduling.

Tours With Food Included

• Cancellation more than 24 hours in advance: 100% refund.
• Cancellation less than 24 hours before the tour: No refund. You may reschedule your tour once at no charge with at least 12 hours' notice, subject to availability.
• No-show: No refund and no rescheduling.

Date Changes

• Shared tours: You may reschedule with at least 4 hours' notice, subject to availability.
• Private tours: You may reschedule with at least 12 hours' notice, subject to availability.

Force Majeure

If events occur outside either party's control (hurricanes, storms, port closures, natural disasters or instructions from the Port Authority), DayTour Bacalar may offer rescheduling or a refund, as appropriate.

4. Safety and Responsibility

• All participants must follow the instructions of our guides or captains. Failure to do so could jeopardize their safety.
• Life jackets must be worn during water activities. Refusing to wear one may result in early termination of the tour without a refund.
• DayTour Bacalar does not teach swimming or snorkeling; the Client is responsible for participating in water activities only when they have the necessary skills.
• Each participant is expected to act responsibly and respectfully toward others, the crew and the natural environment.

5. Release of Liability

By booking and participating in tours offered by DayTour Bacalar, the Client:

• Voluntarily assumes the inherent risks of nautical activities, including but not limited to navigation, entering and leaving the water and possible interactions with wildlife.
• Releases Mantarraya Dorada S. de R.L. de C.V., its representatives, employees and operators from liability for any accident, injury, loss or damage that may arise before, during or after the tour, including situations caused by natural, technical or human factors.
• If the Client has an existing injury, illness or medical condition, the Client declares that they are able to participate at their own risk and will not hold DayTour Bacalar responsible for resulting consequences.

6. Personal Belongings and Photography

• DayTour Bacalar is not responsible for the loss, theft or damage of personal belongings during the tour.
• Forgotten belongings will be held for 15 days. After that period, their return cannot be guaranteed.
• By participating, you grant DayTour Bacalar the right to use your image in photographs or videos taken during the tour for promotional purposes. If you do not wish to be photographed, please inform us before the tour begins.

7. Termination of Service

DayTour Bacalar reserves the right to refuse or terminate service for any Client who:

• Fails to comply with safety rules.
• Acts aggressively or is under the influence of alcohol or illegal substances.
• Fails to respect arrival times or team instructions.
